The Justice Department attorneys in the position of defending the federal Defense of Marriage Act (DOMA) made statements in legal filings that the Obama administration would like to see the federal law repealed.
Justice officials filed court papers Monday that call DOMA “discriminatory.” The filing was written to defend DOMA in a legal challenge.
Bill Duncan, president of the Marriage Law Foundation, said the administration is making a calculated compromise.
“It’s good law, so they can’t completely ignore it,” he explained. “So, what they’re trying to do is make weak arguments and concede as much as possible to the side that wants to redefine marriage.”
