U.S. District Judge Vaughn Walker will not allow several national gay-activist groups to intervene in the California case challenging the state’s marriage amendment. Family advocates called it a partial victory.
Lambda Legal, the National Center for Lesbian Rights and the American Civil Liberties Union are among the groups excluded from a case brought by two same-sex couples who were denied marriage licenses under Proposition 8, the California marriage amendment.
The trial is expected to begin in January.
Jim Campbell, litigation staff counsel with the Alliance Defense Fund, said his group is ready for the important battle to preserve one-man, one-woman marriage in California.
The case also has direct implications for marriage amendments in 29 other states.
“Radical homosexual activists cannot be permitted to use the courts to invent a right to redefine marriage in America,” he said.
